क्या भारतीय समाज में पूर्ण क्रांति या कोई सार्थक बदलाव संभव है? शायद नहीं!!

भारतीय समाज एक विचित्र समाज है! ये बदलाव तो चाहता है लेकिन ये बदलाव का हिस्सा नहीं बनना चाहती. भारतीय समाज एक ढर्रे पे चलने वाला समाज है. ये सही चीजों का हिमायती तो है लेकिन बहुमत फिर भी सार्थक बदलाव के प्रति उदासीनता, आलस और निराशा से भरा है. इसीलिए जयप्रकाश नारायण या वर्तमान में अन्ना हजारे जैसे लोग समाज को झकझोर तो सकते है लेकिन एक सार्थक मूवमेंट को जन्म नहीं दे सकते, लोगो को वैचारिक रूप से उन्नत नहीं कर सकते. गाँधी ने भारत छोड़ो आन्दोलन को गति जरूर प्रदान की लेकिन उसके मूल मे भारत को आज़ाद कराने का संकल्प था, भारतीय समाज के सोचने के तौर तरीके या उसकी कार्यशैली में बदलाव इसके मूल में नहीं था! शायद यही वजह है कि नेहरु के कार्यकाल में ही भ्रष्टाचार के किस्से उभर आये. ये भी उल्लेखनीय है कि गांधी और नारायण जी के आन्दोलन दोनों युवा वर्ग के जोश पे ही आगे बढे लेकिन अंत में या दूरगामी परिणाम “किस्सा कुर्सी का” ही रहा.
ये भारतीय समाज ही है कि आधुनिक काल में भी सरकारी महकमे बनाम प्राइवेट का महत्त्व हावी रहता है. सरकारी चपरासी आपका होनहार दामाद हो सकता है लेकिन एक निपुण कारीगर नहीं!! ये भारतीय समाज ही है जो लड़की की शादी की चिंता से व्यथित रहता है लेकिन दहेज़ के कानून होने के बावजूद हर आदमी शादी में धूमधाम, दहेज़ के लेन देन का सबसे बड़ा उपक्रम करता है सिर्फ और सिर्फ इसलिए कि समाज क्या कहेगा, लोग क्या कहेंगे! ये भारतीय समाज ही है जो अब भी पद की प्रतिष्ठा देखता है, उपरी कमाई देखता है, कलम या कुर्सी कितना फायदा पंहुचा सकती है ये सब देखता है. यही आपके वजूद के मूल्यांकन का पैमाना है और यही पैमाना रहेगा इस भारतीय समाज में. आपकी अच्छाई का कोई मोल नहीं अगर आदमी बिकाऊ नहीं है. इसे आप भौतिकता का तकाज़ा कह ले या फिर उपयोगितावाद का चरम कह ले. साधू संतो से भी मिलते है तो ये भारतीय समाज की दृष्टि है कि वो आश्रम की भव्यता से प्रभावित होता है. वहा की सादगी और दिव्यता असर ही नहीं डालती. ये भारतीय समाज ही है कि फूहड़ क्रिएटिविटी प्रचार का सहारा पाकर ( लेटेस्ट उदाहरण “दिलवाले” का राष्ट्रीय अखबारों में पहले पेज पर फुल साइज़ विज्ञापन देखे ) सबसे ज्यादा कमाई करने वाली फिल्मे बनती है पर वही अच्छी फिल्मो के लिए मल्टीप्लेक्स कल्चर में कोई जगह नहीं!! ना ये फिल्मे रिलीज़ होती है. रिलीज़ होती है तो चलती नहीं, बोरिंग और बकवास कह कर खारिज कर दी जाती है!! इनके कलाकार गुमनामी के अँधेरे में दम तोड़ देते है!!
ये भारतीय समाज की स्याह तस्वीर है कि जो बदलाव, क्रान्ति की बात करते है वे बहुमत द्वारा शक की निगाहों से देखे जाते है! ये बदलाव अगर करते है तो उसका फायदा उठाने की चाह सबमे रहती है लेकिन ऐसे लोगो से लोग दूरी बना कर रखते है! ऐसे लोगो को खुद उसके परिवार वाले और उन्नत भारत का उन्नत समाज “सनकी”, और पागल करार देती है! ये अलग बात है ऐसे “सनकी” और “पागल” लोगो के द्वारा लाये गए बदलाव का हर कोई फायदा उठाता है!! लेकिन ये सबसे बड़ी त्रासदी है इस भारतीय समाज कि बदलाव की बात करने वालो, उसके लिए संघर्षरत रहने वालो के लिए कोई खास स्पेस नहीं. ऐसे लोगो की अंतिम परिणिति या तो असमय मौत में होती है या किसी पागलखाने में उपेक्षित मौत!! ऐसे लोग समाज की नज़रो में जैसा मेरे एक मित्र ने ठीक ही कहा “इरिस्पांसिबल” लोग होते है!! इसलिए इन बदलाव चाहने वालो के पीछे समाज, माफिया या सरकारी व्यवस्था सरकारी इंटेलिजेंस नाम के महकमे के साथ हाथ धोकर पीछे पड़ जाती है.
( मंजुनाथ की मौत ये बताती है कि आजादी हमको सिर्फ ब्रिटिश लोगो से मिली. समाज की गंदगी से आजादी अभी बाकी है. )
ऐसी व्यवस्था सिर्फ आम आदमियों को ही नहीं प्रताड़ित करती. खुद अपने ही विद्रोही सरकारी आदमी लोगो को भी नहीं छोडती, विद्रोही सामजिक कार्यकर्ताओ को भी नहीं बख्शती. सो आप सहज ही समझ सकते है कि साधारण पृष्ठभूमि वाले लोग बदलाव के बारे में कैसे सोच सकते है जब एक सरकारी अफसर को माफिया खुले आम जला डालता है, एक माफिया ट्रैक्टर के नीचे युवा IPS अफसर को रौंद डालता है, मंजुनाथ या सत्येन्द्र दुबे भयानक मौत के शिकार होते है या फिर इसी तरह के लोग और भयंकर षड़यंत्र के शिकार होते है. और फिर काल के प्रवाह के चलते ऐसे लोग विस्मृत हो जाते है. भारतीय समाज यथावत अपने समस्त तमाशे के साथ चलता रहता है इस उम्मीद के साथ अच्छे दिन आयेंगे, अच्छे बदलाव होंगे लेकिन हममे से कोई पहल नहीं करेगा, कोई बदलाव की बात नहीं करेगा और हर बदलाव की चाह करने वाले को बुरी तरह प्रताड़ित करना चाहेगा!! बदलाव की इतनी भीषण चाह पर फिर भी बदलाव की राह पे लगे लोगो की इतनी बुरी नियति! सो किसकी शामत आई है जो बदलाव के बारे में सोचे! सिस्टम का हिस्सा बनो और मौज उडाओ. ये सबसे सेफ विकल्प है.
जुडिशियल एक्टिविज्म की बात भी कर ले. वकालत के क्षेत्र से ताल्लुक रखते है तो ये बात क्यों न कहे कि जुडिशियल एक्टिविज्म की सबसे ज्यादा जरुरत तो न्यायालयों के भीतर सबसे ज्यादा है बजाय किसी और क्षेत्र में जहा पेशकार भी पैसा लेता है अगली “डेट” देने के लिए, जहा फैसले केस की मेरिट नहीं आपकी बेंच से प्रगाढ़ ताल्लुकात पे निर्भर है, जहा वकील का रुतबा या चेहरा फैसले पलट देती है, जहा कंटेम्प्ट के कानून का भय इतना है कि सारे वकील लकीर के फकीर बन कर प्रचलित व्यस्था का हिस्सा बन कर अपनी दाल रोटी को सुरक्षित करते है और सारी उम्र बस दाल रोटी को सुरक्षित ही करते रहते है ( और साथ में बदलाव करने वालो को सनकी और पागल कह कर उपहास उड़ाते है ), जहा जज साहिब को सलाम ठोकना आवश्यक है वर्ना आपके हर अच्छे केस का फ्यूचर बस “dismissed” ( खारिज ) होना तय है, और जहा जज साहिब खुद भ्रष्टाचार सहित हर कुकर्म में लिप्त है, जहा डिस्ट्रिक्ट न्यायालयों में हड़ताल/सौदेबाजी ज्यादा और न्याय कम ही होता है ( पर इसके बाद भी जनता इसी चौखट पे आकर न्याय की गुहार लगाती है और कुछ नक्सली/बागी बन कर अपने से न्याय हासिल करते है !!)
लोग मुझसे अक्सर ये पूछते है अरे समस्याए तो सब गिना देते है, कोई हल हो तो बताइए! हम उनसे यही कहते है हल बहुत साधारण है पर क्या आप जैसे जटिल दिमाग इस साधारण से हल को आत्मसात कर सकते है कि पहले बदलाव की सोच रखने वालो का सम्मान करो और उन्हें उचित सरंक्षण दो. सारे अच्छे बदलाव अपने आप खुद हो जायेंगे!! किसी बदलाव करने वाले को आप शक की निगाहों से देखेंगे, उन्हें मुख्यधारा से बहिष्कृत कर देंगे, उन्हें प्रताड़ित करेंगे तो किस मुंह से भारतीय समाज बदलाव की आशा रखता है. ये भारतीय समाज खुद सोचे क्या उसे वास्तव में बदलाव की दरकार है? तब कही वो “हल” के बारे में चिंतित हो! हमारे यहाँ तो सभी सिस्टम का हिस्सा बनना चाहते है दिमाग को बंद करके! लकीर का फकीर बने रहना ज्यादा मुनासिब है इस देश में, सिस्टम में सेट होने के जुगाड़ में ही सारी उम्र चली जाती है यहाँ पर! सो क्रांति या असल बदलाव इस देश में इस मानसिकता के चलते संभव नहीं.
इस पोस्ट के आशय को जो हमने दो कविताये अभी पढ़ी वे बहुत अच्छी तरह से उभारती है. पहली कविता तो “अर्द्ध सत्य” फ़िल्म से है और उस चक्रव्यूह की तरफ इशारा करती है जो बदलाव करने वालो को अपनी गिरफ्त में ले लेती है. दूसरी छोटी कविता रमा शंकर यादव “विद्रोही” द्वारा रचित है जो जवाहरलाल नेहरू विश्वविद्यालय (JNU) से निकाल दिए गए थे कैंपस में धरने इत्यादि में शामिल होने के लिए.

कौन था मैं और कैसा था
यह मुझे याद ही ना रहेगा
चक्रव्यूह मे घुसने के बाद
मेरे और चक्रव्यूह के बीच

The Politics Of Rape In India
Mulayam Singh Yadav: Sometimes even wrong people say right things!
In early 80s one of the popular Hindi flicks revolved around a sensational theme wherein a girl accused a boy of attempting to rape her when she got caught during the seduction stage. As a result of that false accusation, the boy became victim of deep psychological disorder for lifelong. Similarly, a blockbuster Hindi movie released in early 90s shows the protagonist teaching a fitting lesson to her ladylove, who tries to take a revenge by feigning rape! The protagonist makes her very clear that a lady should not stoop down at this level wherein a sexual offence becomes a weapon to settle personal grudges. Not a long back ago the Supreme Court refused to grant relief to a girl who had feigned rape, which led to trial of two innocent youths. They had to ‘suffer the ignominy’ of being involved in such a serious offence!
The Supreme Court in his verdict, without mincing words, stated that ‘evil of perjury’ has assumed alarming proportions and, therefore, girl deserves no sympathy for maliciously setting the law in motion. “It was a settled position in law that so far as sexual offences are concerned, sanctity is attached to a victim’s statement and that the evidence of victim alone is sufficient for the purpose of conviction if it is found to be reliable, cogent and credible.” It’s ludicrous that an absurd hue and cry is being made over Mulayam Singh Yadav’s alleged rape remarks. Before entering into interpretation of his remarks, it would not be offensive to state that there are few takers, including myself, of type of caste-ridden politics played by Mulyam Singh Yadav, Lalu Yadav and Mayawati. They are icons of regressive tendencies in Indian politics, who never allowed their followers to truly embrace progressive ideals. That’s the reason why Uttar Pradesh is still struggling hard to emerge as a developed state!
One needs to be sufficiently cautious while interpreting remarks of Mulyam Singh Yadav. True, his statement “boys…make mistakes” need to be severely condemned as it trivializes the gravity of a serious offence like rape. However, that’s not the only remark he made. One of the flaws committed by Indian and foreign journalists is that they tend to rely more on sensationalism and as a result of that they misquote and misinterpret serious remarks. That’s not only against the spirit of ethics based journalism but such tendencies also lead to volatile situation in various circles of society. I am sure that an ace politician like Mulyam Singh Yadav would have got his intent right when he pointed out a disturbing trend in Indian society, wherein sexual offences have become a tool to serve vested interests.
If law makers are truly interested in equity based legal system then their prime task should be to make laws gender neutral!
The mainstream media eager to cash-in-on the controversial remark failed to highlight the other portion of his speech wherein he stated that “those filing false reports will also be taken to task” so as to stop the misuse of anti-rape law. The mainstream media, controlled by the feminist forces, very shrewdly suppressed this part of the alleged speech. He was demanding a change in anti-rape law not because “boys make mistake” but because its misuse has attained alarming proportions: “Boys and girls fall in love but due to differences they fall apart later on. When their friendship ends, the girl complains she has been raped.” This statement needs to be interpreted in light of scenario prevailing in present day Indian society marred by perverse tendencies even if one has no place for brand of politics played by likes of Mulayam and Mayawati! This time a wrong person has said a right thing. Why are we hell bent to ignore a harsh reality of present age wherein women are not hesitant to put at stake their own dignity if that suits their interests?
Interestingly, cinema is said to be the mirror of society. The filmmakers were far ahead unlike the lawmakers, having their mindset caught in time-warp, in anticipating the disturbing changes in approach of modern Indian women. Unlike the lawmakers who remained glued to perception of “abla nari” (a woman is too innocent and weak to commit any wrong), the filmmakers were bold enough to depict newer trends emerging among women fraternity (refer to movies like Undertrial, Aitraaz, Corporate and etc.). It’s a very recent phenomenon that Supreme Court has taken cognizance of misuse of dowry laws besides being worried about growing trend of perjury cases while dealing with sexual offences. However, it’s quite ironical and travesty of present day grim tendencies that new anti-rape law has no place for gender-neutral provisions. That’s quite shocking. That means law still believes that only men could be perpetrators! How long are the lawmakers going to behave like ostriches having their heads buried in sand?
Needless to state that nobody is suggesting, or rather no one wants that people guilty of sexual offences of serious types should remain above stringent punishment. However, at the same time, it’s also pertinent that fair sex involved in unfair practise of misusing laws should not be allowed to get off scot free. At the same time if law makers are truly interested in equity based legal system then their prime task should be to make laws gender neutral. What’s the point in nurturing illusions of medieval ages? They need to take clue from filmmakers, who are at least honest enough to portray real face of Indian society as it is (even if they do so to ensure flow of cash)! And the journalistic circle should better restrain themselves from viewing everything from political angle. That would augur well for the welfare of Indian society. The media should be more governed by truth than by falsehood, confusion, and twisted truth sponsored by the corrupt feminist forces! It’s really pathetic that biased mainstream media is averse to anything remotely serving the cause of men and is quick to nasty interpretations of well-meaning sentiments. And it’s even more sadder to notice that even social media remained concentrated on personal attacks rather than framing a more logical perspective!

The political party which has no sound policies cash in on populist measures to gain power. If such a political party somehow manages to register its presence in corridors of power, it proves to be an ominous sign for the growth of democracy. Uttar Pradesh is facing similar crisis in the regime of Samajwadi Party. Right from series of communal riots in various parts of states to administrative failures in various major cities the state has been held hostage to dangerous elements masquerading in various forms. The Samajwadi Party wooed young voters by promising laptops and nobody questioned the utility of launching such scheme at cost of taxpayers’ hard earned money. Look at the irony involved that state is reeling under worse power crisis. It appears laptops provided by this government get recharged by darkness! The same money spent on laptops, tablets and etc. could have been diverted to improve the infrastructure involved in production of power. It’s no secret that most power houses operating in state are operating with help of worn out machinery. However, you can’t expect such measures from a government run by unethical minds.
Allahabad, most important city after Lucknow, which is on paper getting 21 hours power supply, is facing huge power crisis. Let’s take into cognizance working of one of the power substations operating in Allahabad, which is home of eminent intellectuals, bureaucrats, writers, poets, judges and journalists. One example is suffice to have idea of how the system is operating under this government’s rule. Kareli power house, an important substation, which supplies power to Kareli and other adjoining areas like Bhavapur, is in total disarray because of its incompetent officials and poor management. It’s now very clear that may be in Mayawati’s regime there were huge scams at ministerial level, the bureaucratic machinery still remained under awe of strict punishment in case of non performance of duty. Under this regime absence of such threat of getting punishment has led to lawlessness and haughtiness on part of officials.
The Kareli substation under Maywati’s regime was one of the best substations operating in the city having a smooth supply in both Hindu and Muslim colonies, even in peak hours during some important festivals like Dussehara or Eid. A telephone was always there to register the complaint of aggrieved consumers and the fault was dealt with in a conscious time bound manner. The same substation is now working in most shabby manner. The employees stationed here are rude while dealing with consumers besides being incompetent. They are not bothered as to how to ensure smooth power supply. Many linemen/technicians on condition of anonymity stated that there is nobody to check huge power theft in this area. As a result of this power theft as many as 20 transformers have blasted in one single month. The staff operating at power houses often gets beaten at the hands of angry public. Prima facie one always blames citizens for such display of violence and angry reactions but if we delve deeper into the cause of mob violence one would realize that ordinary citizens are not that guilty.
For instance at Kareli substation during some critical faults there is no one present to register the complaints of consumers. There is also no telephone, and thus, one living at a distance has to travel many kilometers to reach this substation. Imagine the state of the mind of such consumer if he/she finds that gates are locked from outside during working hours! If the same consumer tries to contact with higher officials over telephone, the officers at the other end don’t give much importance to his/her problems. So what options do power house officials leave for aggrieved consumers other than to react violently? Bhavapur area which is major Hindu colony having distinguished citizens faced 18 hours power failure for two consecutive days which included Dussehara day. Can one imagine the level of collective anger of such residents?
Most of the areas, falling under this substation, for past one and half months are facing huge power cuts. Earlier it was informed that feeders were being changed along with replacement of incoming panel. The residents of this area kept quiet but people lost their cool when even after removal of major faults the areas like Bhavapur, Nihalpur and etc. remained dark for more than 10 or 12 hours at a stretch while the adjoining Muslim areas like Akbarpur remained above such power cuts! The whole Navaratri celebrations along with tableau exhibition was marred by absolute darkness. In fact, this substation is working in a dangerous way too. That’s because no employee of higher rank is placed at this substation. As a result of that staff which is comprised of linemen and few technicians are either missing in night schedule or if that’s not the case they are involved in drinking of beer. Just few weeks ago, a lineman involved in repairing work at Kareli substation in inebriated state suffered serious injuries.
This government has failed to realize that citizens are not impressed by populist measures. To win their hearts the government needs to improve the functioning of public administration. What prevented it to improve the quality of services provided by government bodies? Instead of doing that it’s engaged in divisive policies, which involve huge wastage of taxpayer’s money. It’s time for the electorate to realize that during voting it’s better to have in their view right aspects instead of being swayed by flawed populists measures of parties devoid of vision and sound principles.
Distributing laptops when the whole state is reeling under total darkness! The same taxpayers’ money could have been used to improve power supply.

अँधेरे के मनहूस गर्त में डूबी उत्तर प्रदेश सरकार
ये है करेली पॉवर हाउस. आप खुद देखे किस तरह ड्यूटी आवर्स में इस पर ताला लगा है. ये तब होता है जब कोई बड़ी फाल्ट आ गयी होती है. कर्मचारी बजाय शिकायत सुनने के इस तरह ताला लगाकर गायब हो जाते है.
लैपटॉप बाटती उत्तर प्रदेश की सरकार को शायद इस बात की परवाह नहीं कि बिन रौशनी के ये लैपटॉप कूड़े के ढेर में फेंकने लायक चीज़ है. इस सरकार को शायद ये एहसास नहीं कि जनता इस तरह के वाहियात स्कीम से खुश नहीं होती। जनता तब प्रसन्न रहती है जब जनता से सरोकार रखती आवश्यक सेवाए सुचारू रूप से पहुचती रहती है. लेकिन जिस सरकार में मंत्री और अफसर दोनों बेलगाम घोड़े की तरह हो गए हो वहा फरियाद करने का क्या औचित्य? इलाहाबाद एक महत्वपूर्ण शहर है ये बताने की जरूरत नहीं लेकिन यहाँ जिस तरह सरकारी संस्थाए काम कर रही उससे लगता नहीं लखनऊ में बैठे आकाओ या इलाहाबाद में खुद इस सरकार के नुमाइन्दो को कोई फिक्र है यहाँ के हालातो से. इलाहाबाद में जब सारे शहर में दशहरे की धूम थी शहर का एक ख़ास इलाका भावापुर जो करेली पॉवर हाउस से संबद्ध है अँधेरे में डूबा रहा दो दिनों तक लगातार। सिर्फ दो दिनों तक अँधेरे में डूबे रहता तो कोई बड़ी बात नहीं थी. ये इलाका पिछले ढेढ़ महीने से बिजली की समस्या से जूझ रहा. हद तब हो गयी जब दशहरे के दिन और उसके अगले दिन १८ घंटो से अधिक बिजली बेवजह गायब रही. और यहाँ का एक मंत्री को ये सफ़ेद झूठ बोलते लाज नहीं आई कि इलाहबाद शहर में तो २१ घंटे बिजली आती है!
मायावती के शासन काल में कम से कम सरकारी अफसरों में एक जवाबदेही का भय था. यही करेली का सबस्टेशन सबसे बेहतर पॉवर हाउस में से एक था मायावती के शासन में. पब्लिक की समस्या को सुनने के लिए एक टेलीफोन भी था जिससे कम से कम शिकायत तो दर्ज हो ही जाती थी. समाजवादी पार्टी के सत्ता में आते ही इस पॉवर स्टेशन के अधिकारी निरंकुश हो गए. टेलीफोन कहा गया पूछने पर कर्मचारी बत्तमीजी से बतायेंगें कि खो गया है! दशहरे के अवसर पर किसी इलाके की बिजली अट्टारह घंटो से अधिक काट देना एक जुर्म है क्योकि शिकायत करने पर कुछ घंटो में बिजली देने का प्रावधान है.लेकिन इस करेली पॉवर स्टेशन में फैली दुर्दशा इस सरकार में फैली अराजकता को स्पष्ट दर्शाती है और ये दिखा जाती है कि इस सरकार की कार्यप्रणाली किस प्रकार की है.
इस पॉवर स्टेशन में पिछले डेढ़ महीनो से समस्या चल रही है. पहले पहल पूछने पर ये बताया जाता था कि फीडर बदले जा रहे है और उसके बदलते ही इस इलाके में ट्रांसफार्मर फूंकने इत्यादि की समस्या हल हो जायेगी. इस बाबत अधिकारियों के बयान कई दिनों तक अखबार में छपते रहे और जनता धैर्य धारण किये रही. बिजली के अधिकारी लोगो को आप अक्सर सुनते मिल जायेंगे कि साहब फला केंद्र पर कर्मचारियों को पब्लिक ने पीटा. अधिकारी इसके पहले अपनी करतूतों को जाहिर भी कर दिया करे तो बेहतर रहेगा! इस करेली पॉवर स्टेशन पे फैली अराजकता को देखे और ये पाठक सोच कर बताये जब पानी की किल्लत, गर्मी और उमस से जूझती जनता की समस्या को पॉवर हाउस के कर्मचारी/अधिकारी संज्ञान में लेना जरूरी ना समझे तो क्या हो? यहाँ के इलाके के अधिकतर ट्रांसफार्मर फूँक गए है. क्यों? क्योकि यहाँ के अधीनस्थ कर्मचारी नाम न छपने के शर्त पर ये आपको बता देंगे कि अफसरों ने कितने अवैध कनेक्शनो को कम क्षमता वाले ट्रांसमिशन पर डाल रखा है. क्या नतीजा होगा इसका?
आप पूछेंगे क्यों नहीं अधिकारी इस बात को ध्यान में लेते? तो इस सबस्टेशन की कहानी ये है कि इस पॉवर हाउस में कोई अधिकारी तकरीबन ना के बराबर बैठता है. इसका नतीजा ये है कि लाइनमैन टाइप के लोग रहते है जिनको अगर कोई हादसा हो जाए तो ये भी नहीं मालूम कि करना क्या है. क्योकि कोई अधिकारी भी नहीं बैठता लिहाजा नीचे के कर्मचारी या तो आपको मिलेंगे नहीं या अगर दिखे भी तो ड्यूटी के वक्त दारुबाज़ी जैसी हरकतों में लिप्त मिलेंगे. अगर कोई बड़ी फाल्ट आ गयी तो ये सबस्टेशन में ताला लगाकर भाग जायेंगे. इसी सबस्टेशन पर कुछ दिनों पहले एक कर्मचारी नशे में पोल पर चढ़ गया और बड़े हादसे का शिकार हो गया. अगले दिन इलाहाबादी पत्रकारों ने पत्रकारिता के गिरते स्टैण्डर्ड को दर्शाते हुए इस घटना को गायब करते हुएं लिखा कि हाई टेंशन वायर टूट जाने से करेली सबस्टेशन की बिजली गुल!
ये पॉवर स्टेशन मुस्लिम बहुल्य इलाके में पड़ता है. इस वक्त इस केंद्र में अधिकतर इसी वर्ग के कर्मचारी भी तैनात है जो कितने काबिल है वो आप अगर ऑफ द रिकार्ड अधीनस्थ कर्मचारियों से पूछे तो खुद समझ में आ जाएगा! ये बताना कोई बहुत जरूरी ना होता अगर इस इलाके में इस बात की सुगबुगाहट ना होती कि इस दशहरे में इस तरह के लापरवाही सुनियोजित थी. जाहिर है ये बात इस केंद्र से के कर्मचारियों के बीच से ही उठी है. इसी शहर में कुछ दिनों पहले अखिलेश यादवजी का आगमन हुआ. जिस करेली केंद्र को अधिकारी अभी कई दिनों से बुरी तरह फाल्ट ग्रसित बता रहे थें उसी से अबाधित २४ घंटे बिजली आई. उनके जाने के अगले दिन बिजली फिर चली गयी. केंद्र फिर फाल्टग्रस्त हो गया!
खैर मै सुनी सुनाई बातो पे कम यकीन रखता हूँ. दशहरे के दूसरे दिन जब बिजली सब जगह आ रही थी (भावापुर से जुड़े मुस्लिम इलाको जैसे अकबरपुर इत्यादि में) पर भावापुर में बिजली नदारद थी. फ़ोन करने किसी अधिकारी के पास सिवाय बहानेबाजी के कोई ठोस जवाब नहीं था कि क्यों ऐसा हो रहा है और ऐसा कब तक होगा. ये इस सबस्टेशन की कहानी नहीं है. ये इस सरकार की विकृत और बीमार मानसिकता की निशानी है. शायद इस सबस्टेशन के लाइनमैन दबी ज़बान में कडुवा सच कह रहे है कि इस तरह के गैर जिम्मेदार अफसरों के रहते आप किस सुधार की कल्पना कर सकते है! तकलीफ इस बात की भी है कि इसी इलाके में हाई कोर्ट के अधिकारी, अन्य विभागों के अधिकारी, हाई कोर्ट के जज भी रहते है. शहर के अन्य उच्च अधिकारी अगर इस बात को संज्ञान में नहीं ले रहे है तो ये क्यों खामोश बैठे है? इस इलाके की साधारण पब्लिक जो अब बहुत गुस्से में आ गयी है वो शायद पीटने पाटने के सिवाय कुछ ज्यादा ना करे लेकिन हाई कोर्ट या इस शहर के अन्य अधिकारी तो इस करेली केंद्र के कर्मचारियों/ अधिकारियो को उनकी इस लापरवाही पर कड़ी सजा दिला सकते है. यही करने का वक्त आ गया है. सुधार ऐसे ही आता है.
लैपटॉप बाटने से पहले बिजली तो ठीक तरह से देना सीखे ये सरकार!! सरकारी पैसा बिजली देने में लगाए बेहतर नतीजे मिलेंगे।

ये सब कहा छुपा के रखे जाते है?
अखिलेश यादव जब भारतीय राजनीति में अहम् किरदार अदा करने वाले उत्तर प्रदेश के मुख्यमंत्री बने तो कुछ लोगो में शायद ये झूठी आस जाग उठी कि शायद एक युवा चेहरा कुछ बेहतर परिवर्तन ला दें. लेकिन सिर्फ चेहरे बदलने से चाहे वो युवा ही क्यों ना हो तब तक बात नहीं बनती जब तक आप के पास स्पष्ट नीति ना हो. हुआ भी वही लोक लुभावनी योजनाओं के दम पर बनी ये सरकार आज ना सिर्फ विवादों में फँस गयी है जहा नौकरशाह सहमे से है बल्कि नित नए दंगो ने प्रदेश को अशांत क्षेत्र बना दिया है. मुज़फ्फरनगर के दंगे वीभत्स तस्वीर पेश करते है और ये बताते है कि राजनेता किस हद तक गिर सकते है अपने प्रभाव को बचाने के लिए.
हम कानून राज की बात करते है और दामिनी बलात्कार काण्ड पर इस देश में बहुत उबाल उठा लेकिन मुजफ्फरनगर में इस दंगे से पहले कितने बलात्कार हिन्दू औरतो के साथ मुस्लिमो ने किये उसको किसी सरकार ने संज्ञान में लेने की जरुरत क्यों नहीं महसूस की? इसकी वजह से सात सितम्बर को जाट समुदाय ने एक पंचायत बुलाई गयी बहु बेटियों के सुरक्षा के लिए. इसमें शामिल होने के लिये जा रहे लोगो पे हमले हुए और उसके बाद स्थिति बेकाबू हो गयी. जब किसी सरकार के पास नीति नहीं होती तो ताकतवर चेहरे कठपुतली की तरह सरकार को नचाते है. यही हाल इस वर्तमान सरकार का भी है. दंगे किस कारण से हुए ये तो कई खबरों का विषय बन गयी है लेकिन इस जरूरी तथ्य पर शायद चर्चा ना हुई हो कि किस तरह खतरनाक हथियारों का जमावाड़ा जिसमे ऐ के 47 बंदूके तक शामिल है मुस्लिम वर्ग में इकठ्ठा है! हैरानगी की बात है कि मस्जिद जो इबादत का ठिकाना होना चाहिए इन हथियारों को छुपाने का केंद्र बनती जा रही है. इंटेलिजेंस विभाग क्या सिर्फ छूरी कट्टे की तफ्तीश के लिए बनी है?
ये केंद्र सरकार और राज्य सरकार के इन विभागों से पूछा जाना चाहिए कि जब धार्मिक स्थल इस तरह के आतंकी गतिविधियों का ठिकाना बन जाए तो उसके पास क्या रास्ते है इनको समाप्त करने के? या अल्पसंख्यक वर्ग के लोग मनमानी करे और प्रशासन खामोश रहे तो उसके क्या नतीजे होंगे? क्योकि ये तय है कि अगर कार्यवाही हुई तो वही मुस्लिमो के साथ भेदभाव हो रहा है, उन्हें सताया जा रहा है, फँसाया जा रहा है इस तरह का शोर हर तरफ से उठेगा। इसलिए अगर सरकार के पास हिम्मत ना हो तो कम से कम सुप्रीम कोर्ट या हाई कोर्ट इस तरह के भयानक सच को स्वतः संज्ञान में लेकर केंद्र और राज्य सरकार को विवश करे ये बताने के लिए कि इसके रोकथाम के लिए इनके पास क्या तरीके है और अब तक इन्होने क्या किया है?
गुजरात के दंगो पे गोधरा का सच भुलाकर सेक्युलर मीडिया ने इस बात का बहुत रोना रोया कि गुजरात सरकार ने समय रहते कार्यवाही नहीं की तो अब उत्तर प्रदेश में जो हमने देरी देखी, तथ्यों को नष्ट करके मुस्लिम वर्ग को राहत पहुचाने की कोशिश देखी उसके क्या मतलब निकाले जाए? यहाँ तक कि केंद्र सरकार भी ये कह रही है कि दंगो के भयावहता के बारे में प्रदेश सरकार ने उसे अँधेरे में रखा. खैर इस देश की राजनीति ये हो गयी है कि महिलाओ और अल्पसंख्यको को लुभाओ। उनके हर कुकर्मो पे पर्दा डाल दो. हो सकता है तात्कालिक रूप से महिलाओ और अल्संख्यको को ये सब भला लगे. लेकिन इसका दूरगामी परिणाम ये होगा कि उन महिलाओ और मुस्लिमों को तकलीफ झेलनी पड़ेगी जिनका इस गन्दी राजनीति से कोई वास्ता नहीं होगा। और सबसे बड़ा नुक्सान तो इस देश को होगा जिसने आज़ादी के बाद इस तरह के अलगाववादी और आसुरी नेताओ के उदय की कल्पना तक ना की होगी।

Flawed Amendments In Hindu Marriage Laws Are Destroying Hindu Families!
हिन्दू विवाह अधिनियम को संशोधित करने में कांग्रेस सरकार जो अति सक्रियता दिखा रही है वो परेशानी और अचम्भे में डालती है. इस सरकार का कार्यकाल एक साल के भीतर ही ख़त्म होने वाला है लिहाज़ा ये अति सक्रियता आत्मघाती है. सम्पति के बटवारे के बारे में इसकी टेढ़ी चाल भारतीय परिवारों के विघटन का कारण बन सकती है. प्रस्तावित क़ानून में बटवारे वाले सेक्शन को लेकर जो उहापोह वाली स्थिति उत्पन्न हो गयी है सरकार के भीतर उससे स्पष्ट है कि इस सरकार के मंत्री खुद भ्रम के स्थिति में है और इस कानून में निहित संपत्ति बंटवारे और मुआवजे से सम्बंधित बिन्दुओ पर वो एकमत रूख नहीं रखते है. हिंदू विवाह अधिनियम’ की धारा 13-बी और ‘विशेष विवाह अधिनियम’ की धारा 28 आपसी सहमति से तलाक के अंतर्गत संपत्ति बंटवारे/ मुआवज़े पर जो सरकार के भीतर अन्तर्विरोध उभर कर आये है उससे ये समझ में आता है कि इस कानून के मूल तत्वों के बारे में सरकार में शामिल मंत्रियो से लेकर अन्य पार्टी के सांसदों को ज्यादा कुछ नहीं पता है . इससे ये सहज ही समझा जा सकता है कि जनता जिसका वो प्रतिनिधित्व करते है उनमे कितना भ्रम व्याप्त होगा। फिर भी ये सरकार इस संशोधन को इतनी जल्दबाजी में कानूनी जामा पहनाना चाहती है ये हैरान करता है.
ये बताना आवश्यक रहेगा कि सरकार ने संशोधन को पास कराने की हड़बड़ी में लॉ कमिशन और संसदीय स्थायी समिति को पूरी प्रक्रिया से बाहर रखा है. इसके खतरनाक दुष्परिणाम होंगे और इस तरह के कानूनों से भारत के युवक-युवतियों का भविष्य अँधेरे के गर्त में जा सकता है. ये निश्चित है कि अगर ये बिल अपने प्रस्तावित स्वरूप में पास हो गया तो ये एक और उदाहरण होगा गैर जिम्मेदाराना तरीके से प्रक्रियागत खामियों से लैस कानून को अस्तित्व में लाने का। पुरुषो एक अधिकारों का प्रतिनिधित्व करने वाली अग्रणी संस्था सेव इंडिया फॅमिली फाउंडेशन (SIFF) ने इस हिंदी विवाह अधिनियम (संशोधन) बिल, २०१०, को अपने वर्तमान स्वरुप में पारित कराने की कोशिशो की तीखी आलोचना करते हुए इस खतरनाक संशोधन को पूरी तरीके से नकार दिया है.
सेव इंडिया फॅमिली फाउंडेशन (SIFF) का ये भी कहना है कि न्यायधीशो को इस कानून के तहत असीमित अधिकार देना किसी तरह से भी जायज नहीं है खासकर महिलाओ से संबधित प्रतिमाह गुज़ारा भत्ता /मुआवज़े के निर्धारण में.
क्या कहता है ये कानून:
विवाह अधिनियम (संशोधन) विधेयक 2010’ “असुधार्य विवाह भंग’ को हिंदू विवाह अधिनियम 1955 और विशेष विवाह अधिनियम 1954 के तहत तलाक मंजूर करने के एक आधार के रूप में स्वीकार करता है. इसके साथ ही तलाक के मामले में अदालत पति की पैतृक संपत्ति से महिला के लिए पर्याप्त मुआवजा तय कर सकती है. विधेयक में पति द्वारा अर्जित की गई संपत्ति में से पत्नी को हिस्सा देने का प्रावधान है.
कुछ आवश्यक बिंदु:
इस कानून को महिलाओ के पक्ष में बताना खतरनाक है क्योकि भारत में सत्तर प्रतिशत परिवार गरीब वर्ग में है जो ज्यादातर क़र्ज़ में डूबे है और जिनके पास संपत्ति नाम की कोई चीज़ नहीं है, जिनके ऊपर पहले से ही बेटी बेटो के भरण पोषण और उनके शादी ब्याह जैसी जिम्मेदारियां है. ये कानून केवल एक ख़ास वर्ग में सिमटी सम्पन्न महिलाओ को ध्यान में रखकर अस्तित्व में आया है लिहाज़ा मुख्य धारा के राजनैतिक दलों को इसके विरोध में खड़े होकर इसके खिलाफ वोटिंग करनी चाहिए। ऐसा इसलिए कि इस कानून के पारित होने के बाद तलाक के प्रतिशत में अगले दस सालो में लभग तीस प्रतिशत तक की बढ़ोत्तरी हो सकती है.
प्रस्तावित हिन्दू विवाह संशोधन को सम्पूर्णता में देखे जाने की जरूरत है जैसे कि संयुक्त रूप से बच्चो का पालकत्व या बच्चों की जिम्मेदारियों के वित्तीय वहन से सम्बंधित कानून की इसमें क्या भूमिका रहेगी. सिर्फ मासिक भत्ते के निर्धारण में सक्रियता दिखाना उचित नहीं। क्या पति ताउम्र भत्ता गुज़ारा देता रहेगा संपत्ति बंटवारे के बाद भी जिसका हिस्सा खुद की संपत्ति और विरासत में मिली संपत्ति से मिलकर बनता है? ये कुछ अति महत्त्वपूर्ण बिंदु है जिनको संज्ञान में लेना आवश्यक है और इन्हें उनके बीच चर्चा में शामिल करना है जो इन कानूनों से प्रभावित हो रहे है. अव्यवस्थित रूप से निर्धारित बिन्दुओ को कानून बना के पास करना बेहद गलत है.

सेव इंडिया फॅमिली फाउंडेशन (SIFF) का सरकार को निम्नलिखित सुझाव:
सरकार इस कानून को तुरंत वापस लें और मौजूदा संसदीय अधिवेशन में इसे ना पेश करे. सरकार इस कानून की भाषा में परिवतन करे और इस लिंग आधारित भेदों से ऊपर करे जिसमे पति (husband) और पत्नी (wife) को ” जीवनसाथी” ( spouse) और स्त्री (man) और पुरुष (woman) को ” व्यक्ति” (person) में परिवर्तित किया जाए. इसके साथ ही किसी भी जीवनसाथी को तलाक़ अर्जी का विरोध करने की छूट हो कानून की समानता के रौशनी में. सरकार इस बात का भी निर्धारण करे कि अर्जित संपत्ति के निर्माण में पत्नी का क्या सहयोग रहा है या पति के परिवार के भौतिक सम्पदा के विस्तार में क्या योगदान है. इसको निर्धारित करने का सूत्र विकसित किया जाए. इसके निर्धारण में शादी के अवधि को ध्यान में रखा जाए, बच्चो की संख्या का ध्यान रखा जाए, और क्या स्त्री कामकाजी है या घरेलु. अगर स्त्री तीन बच्चो की माता है, वृद्ध सदस्यों की देखरेख का जिम्मा ले रखा है, तो उसका योगदान अधिक है बजाय उस स्त्री के जो कामकाजी है और जिसके कोई बच्चे नहीं है एक साल की अवधि में.
इस सूत्र के मुताबिक ही किसी व्यवस्था को संचालित किया जाए जीवनसाथी को प्रतिमाह भत्ते के सन्दर्भ में, मुआवज़े के सन्दर्भ में या किसी और समझौते के सन्दर्भ में. न्यायधीश महोदय इस सूत्र की रौशनी में अपने विवेक का इस्तेमाल कर उचित फैसले लें. लिहाज़ा इस सूत्र के अंतर्गत अगर स्त्री के सहयोग का अनुपात पति या उसके परिवार के संपत्ति के अर्जन में पूरी संपत्ति के मूल्य से अधिक है तो उसे पूरी संपत्ति पर हक दिया जा सकता है. अगर पत्नी इसको लेने से इनकार कर सकती है तो वो मासिक गुज़ारे भत्ते वाले विकल्प को अपना सकती है. कहने का तात्पर्य ये है कि संपत्ति में हिस्सेदारी के बाद उसका मासिक गुज़ारे भत्ते को लेते रहने का अधिकार ख़त्म हो जाता है. दोनों विकल्पों का लाभ लेने का हक जीवनसाथी को नहीं मिलना चहिये.
सरकार को इस सूत्र को अस्तित्व में लाने के लिए एक कमेटी या योजना आयोग का गठन करना चाहिए.
सरकार को सयुंक्त भरण पोषण का अधिकार बच्चे के बायोलॉजिकल अभिभावक द्वारा और बच्चे के ग्रैंड पेरेंट्स से स्थायी संपर्क को अनिवार्य कर दिया जाए, जब तक कि कोर्ट इसके विपरीत राय ना रखती हो. इसके अनुपालन के अभाव को आपराधिक जुर्म के श्रेणी में रखा जाए। अगर कोई अभिभावक इस सयुंक्त के जिम्मेदारी से मुंह मोड़ रहा है या ग्रैंड पेरेंट्स से संपर्क में बाधा डाल रहा है तो इसको अपराध माना जाए.
सरकार ये सुनिश्चित करे कि न्यायालय को अपने विवेक के अधिकार का इस्तेमाल करने की सीमित आज़ादी हो संपत्ति बटवारे के निर्धारण में, मासिक गुज़ारे भत्ते के सन्दर्भ में और बच्चे के पालन पोषण सम्बन्धी मामलो में. बहुत ज्यादा अधिकार न्यायालय को देने का मतलब ये होगा कि कोर्ट का अवांछित हस्तक्षेप मामले को और जटिल बना देगा या कोर्ट का गैर जिम्मेदाराना रूख स्थिति को और विकृत कर देगा। अधिकतर पुरुष फॅमिली कोर्ट पे भरोसा नहीं करते, क्योकि इस तरह की कोर्ट पुरुषो के अधिकार के प्रति असंवेदनशील रही है. न्यायालय वर्षो लगा देती है पति को अपने बच्चो से मिलने का फैसला देने में और तब तक बच्चे की स्मृति पिता के सन्दर्भ में धूमिल पड़ जाती है.
सरकार ये सुनिश्चित करे कि महिला पैतृक संपत्ति और वहा अर्जित संपत्ति में जो हिस्सेदारी बनती हो उसे अधिग्रहित करे. उसे अपने कब्जे में लें. सरकार को हिन्दू विवाह अधिनियम में संशोधन करके महिला को अपने पिता के घर में रहने का स्थान सुनिश्चित करे , ताकि कम अवधि वाली शादी में अलगाव की सूरत में उसे रहने की जगह उपलब्ध हो. अगर माता पिता इस सूरत में उसे पति के घर जाने के लिये विवश करते है तो इसे अपराध की श्रेणी में रखा जाए. इसी प्रकार अगर महिला के माता पिता या महिला के भाई उसे पैतृक संपत्ति/ अर्जित संपत्ति में हिस्सा देने से इनकार करते है तो इसे असंज्ञेय प्रकार का अपराध माना जाए.
उन्होंने कहा कि अगर पति-पत्नी में से कोई भी एक व्यक्ति अगर संयुक्त आवेदन देने से इनकार करता है, तो दूसरे को आपसी सहमति के बजाय अन्य आधार पर तलाक के लिए आवेदन देने की अनुमति दी जानी चाहिए.

इस देश में कानून बना देने ही को सब समस्यायों का हल मान लिया गया है. और इस तरह के दिशाविहीन कानून जो प्रक्रियागत कमियों से लैस है उनका अस्तित्व में आना तो और भी खतरनाक है. वो इसलिए कि न्यायालय हमारे यहाँ किन दुराग्रहो से अधीन होकर काम करते है वो सब को पता है. एक तो सिस्टम गलत तरीके से काम करता है और दूसरा न्याय के रास्ते में इतने दुराग्रह मौजूद है कि सिर्फ लिखित कानून बना देने से सही न्याय मिल जाएगा ये सिर्फ एक विभ्रम है. इस तरह के पक्षपाती कानून सिर्फ भारतीय परिवार का विनाश ही करेंगे जैसा कि दहेज कानून के दुरुपयोग से हुआ है. सिर्फ मंशा का सही होना ही काफी नहीं बल्कि आप किस तरह से उनका सही अनुपालन करते है ये आवश्यक है. ये तो सब थानों में बड़े बड़े अक्षरों में लिखा रहता है कि गिरफ्तार व्यक्ति के क्या अधिकार है पर क्या थानेदार साहब इन सब बातो की परवाह करके कभी थाने में काम करते है? नहीं ना! यही वजह है कि इस तरह के अपूर्ण कानून न्याय का रास्ता नहीं वरन तबाही का मार्ग खोलते है. हिन्दू विवाह अधिनियम में इस लापरवाही से संशोधन करके पहले से इन कानूनों से त्रस्त हिन्दू परिवारों पर एक और घातक प्रहार ना करे.

सरबजीत की मौत बेहद दुखद खबर है। ये अलग बात है कि मुझे आश्चर्य नहीं हुआ। ये मौत सम्भावित थी। ये एक तयशुदा मौत थी। पकिस्तान जैसे कानून विहीन और अराजकता के शिखर पर स्थित देश के लिए किसी की मौत क्या मायने रख सकती है! वो तो केवल ओसामा बिन लादेन को शरण दे सकती है फूलप्रूफ। दाऊद इब्राहिम और अजहर महमूद को ही बेहतर पनाह दे सकती है। सरबजीत की हिफाज़त करके उसे क्या मिलता? लिहाजा सरबजीत का मरना तय था। कसाब और अफज़ल गुरु के फांसी लग जाने के बाद अन्दर ही अन्दर सुलगते पाकिस्तान के लिए सरबजीत से बेहतर बलि का बकरा तो कोई हो ही नहीं सकता था। सरबजीत की मौत तो उसी वक्त तय हो गयी थी जब पाकिस्तान समर्थित दो आतंकवादी कसाब और अफज़ल गुरु फांसी पे लटका दिए गए।
ये शान्ति वार्ता की नौटंकी, सरबजीत को माफ़ी देने की नौटंकी, उसका बेहतर इलाज़ कराने की नौटंकी ये सब आवरण उस कुटिलता को छुपाने के लिए था जिसकी झलक हर नज़र रखने वाले को साफ़ साफ़ दिख रही थी। सिर्फ ना देख पाने का भ्रम भारत की सरकार कर रही थी। खैर सरबजीत की मौत से एक बात तो साफ़ हुई। दो राष्ट्रों की राजनीति में मोहरे बनते है आम आदमी। जब मै राष्ट्र शब्द का इस्तेमाल कर रहा हो तो इसका मतलब ये नहीं है कि पाकिस्तान को मै एक राष्ट्र के रूप में देख रहा हूँ। ये एक राष्ट्र नहीं है। शैतानी लोगो का हुजूम है। शैतानी लोगो का भीड़ तंत्र है जहा पे राष्ट्रपति कोर्ट से भागकर नज़रबंद हो जाता है। खैर मै बता रहा था कि दो राष्ट्रों की दुश्मनी का शिकार सबसे कमज़ोर और मासूम लोग होते है।
कोई बताये सरबजीत का गुनाह क्या था कि पहले तो सोलह साल जेल में काटे बिना किसी गुनाह के और फिर इस तरह बर्बर मौत? उसकी मौत का जिम्मेदार कौन सा राष्ट्र ज्यादा है? रीढविहीन नेताओ के जरिए शान्ति की बात करता भारत या गुनाहों को साए में पलता पाकिस्तान? खैर एक बात तो समझ में आई की जेल में कैदियों को न्याय पाने की आशा से नहीं रखा जाता है बल्कि अक्सर सरकार की आँख की किरकरी बन चुके लोगो को चुपके से खत्म कर देने के लिए रखा जाता है। चूकि मौत पाकिस्तान में एक भारतीय की हुई है लिहाज़ा मानवाधिकार की वकालत करने वालो का ना भौकना लाजमी हो जाता है। ये तब भौकते है अगर भूले से कोई जम्मू कश्मीर में कोई भारतीय सैनिक के हाथो मारा जाता है। इनकी मुखरता तब देखते बनती है।
सरबजीत की आत्मा को शान्ति मिले। मेरी तरफ से यही विनम्र श्रद्धांजलि है सरकारी नौटंकी के इस दौर में। सबसे दुखद यही है कि मरते सिर्फ मासूम आदमी ही है। बिलखते है शोक संतप्त परिजन ही है। मुल्क के नेता तो हर अवसर को कैश कर लेते है। दुःख हो या सुख हर रास्ता सत्ता की तरफ ही मुड़ जाता है।

Sadhvi Pragya’s Case: Severe Violation Of International Norms Related With Rights Of Prisoners!
Paying A Heavy Price For Representing Cause Of Hindus!
Sadhvi Pragya Singh, the prime accused in the 2008 Malegaon blasts, might not be the “Goose” which lays the golden eggs for secular media. After all, the “Hindu” tag makes one unworthy of eliciting conscious attention. Her sympathetic approach towards the causes related with Hindus have made her untouchable not only for the major political parties but also for the mainstream media obsessed with issues related with the minorities.
The article is not focused on elements associated with her involvement in Malegaon blast since they are sub judice but it’s a take on inhuman treatment meted out to her in name of having confession. It’s disgusting that barbaric methods used upon her went unnoticed. The mainstream media was highly conscious in pursuing the aspects related with Afzal, Kasab and many others in the same category, ensuring that their human rights do not get violated. It clamoured for their fair and just trial. However, the same zeal and enthusiasm was strikingly absent while dealing with issues pertaining to Sadhvi Pragya. On the contrary, the mainstream media was busy targeting the ghost of Hindu terrorism-the by-product of pervert secular minds.
Justice V.R. Krishna Iyer’s landmark judgement in Sunil Batra Vs Delhi Administration,1978, sets the basic principles pertaining to rights of prisoners quite emphatically: “No prisoner can be personally subjected to deprivation not necessitated by the fact of incarceration and the sentence of the court. All other freedoms belong to him to read and write, to exercise and recreation, to meditation and chant, to comforts like protection from extreme cold and heat, to freedom from indignities such as compulsory nudity, forced sodomy and other such unbearable vulgarity, to movement within the prison campus subject to requirements of discipline and security, to the minimal joys of self-expression, to acquire skills and techniques. A corollary of this ruling is the Right to Basic Minimum Needs necessary for the healthy maintenance of the body and development of the human mind. This umbrella of rights would include: Right to proper Accommodation, Hygienic living conditions, Wholesome diet, Clothing, Bedding, timely Medical Services, Rehabilitative and Treatment programmes.”
Sadhvi Denied Bail??
In fact, Justice V.R. Krishna Iyer strongly asserted that “Convicts are not by mere reason of the conviction denuded of all the fundamental rights which they otherwise possess.” His sentiments are on par with principles established by many International bodies working for the restoration of human rights. “No one shall be subject to torture or cruel, inhuman or degrading treatment of punishment” (Universal Declaration of Human Rights, 1948). The United Nations Covenant on Civil and Political Rights also echoes the same feelings: “All persons deprived of their liberty shall be treated with humanity and with respect for the inherent dignity of the human person” (UNICCPR, 1966).
It’s learnt that Sadhvi Pragya Singh was subjected to worst kind of animal treatment inside the boundaries of prison. She was shown porn movies, forced to consume non-vegetarian diet, and also mercilessly beaten naked. The severity of the inhuman treatment reached its crescendo just because she represented a Hindu organisation! Can you imagine this sort of treatment to any top leader representing minorities? One prominent leader belonging to minority community, known for his penchant for issuing bogus fatwas, has many criminal cases pending against him but he is roaming scot-free. Can our criminal justice system dare to deal with such absconders the same way? In fact, even the Hindu organizations are guilty of misfortune which has become fate of Sadhvi Pragya. If the Hindu organizations are so interested in restoring the dignity and self-respect of Hindu community, then they should have a proper mechanism to save their workers/ volunteers from the onslaught of negative forces. However, that’s not the reality. These Hindu bodies like any other bodies are involved in petty politics. Or else, they would have left no stone unturned in highlighting the violation of International norms in case of Sadhvi Pragya.
Not many know that Sadhvi Pragya has been diagnosed with cancer (grade 3) and requires serious medication. Just few days back her condition deteriorated and she suffered partial paralysis to the left side of her body. Well, her fate now rests on the will of Lord. However, the treatment meted out to her exposed the flaws of criminal justice system functioning in India. The brutal treatment inflicted upon her does not surprise those who are aware that how our system operates, wherein a 10-year-old girl was put behind bars by women cops when she went to Police Station, along with her mother, to register a complaint against a local goon for allegedly raping her. The rights of the complainants or rights of the prisoners exist only on paper. This nation does not recognize the rights of an individual in practical terms. Anyway, Sahdhvi Pragya’s case also brought in open the real elements gone into the making of organisations representing the cause of Hindu. They are involved more in dirty politics than working for the cause of Hindus in determined way. Let’s learn to honour the dignity of people of substance to make this great nation move ahead with right set of values.

The Chief accused in the Delhi gang-rape case, Ram Singh, committed suicide.
“The main accused in the Delhi gang-rape case, Ram Singh was found dead in Tihar Jail on Monday morning in mysterious circumstances….A police guard found Singh hanging from the grill of his prison cell at 5:45 am, while there were three other inmates in the cell. They claimed they were asleep and had heard nothing…..Home minister Sushil Kumar Shinde said the death was a major security lapse on the part of prison authorities, saying the preliminary probe indicated it was suicide. “There were three other inmates in the cell in which Singh was found hanging,” Shinde said.” ( The Economic Times)
Agreed that Indian prisons have become operational centers for organized crime and death inside prison is a commonplace affair, which is often sponsored by police with the help of inmates. The fact that Indian prisons are breeding ground for henious crimes was the point I had highlighted when Supreme Court granted bail to Binayak Sen on the ground that “Visitors are screened and searched by the jail staff. Jailors are there to oversee all these things. So, the question of passing letters or documents doesn’t arise.” I had strongly objected to such a misplaced stand of Supreme Court in my article devoted to granting of bail, wherein I stated: “Anybody who knows the Indian jails know quite well that all big criminals are operating from inside the jails. The contract to kill (Supari) is being ordered from inside the jails via the mobile. A surprise raid in any Indian jail would always lead to discovery of drugs, weapons, mobile phones and other prohibited things.” However, for Supreme Court and other paid media publications the prison at that time was no less than temple wherein visitors came with noble intentions.
After the murder of prime accused in Delhi gang-rape, once again the whole episode would be projected in one particular way with talks related to security within jails gaining prominence. Some conspiracy theories by paid media shall also be highlighted that would project police as the chief villain. However, for a conscious mind, that’s merely tip of the iceberg. In fact, when the Delhi gang-rape incident took place, and the paid media side-by-side huge number of protesters demanded justice for the unfortunate girl with candles and placards having slogans “Hang the rapists”, the author had suspected that there is more than meets the eye. However, being a lone voice, the feeling got suppressed even as this writer along with other thinking souls tried to point out the murkier game played behind the curtains with dubious role of police.
The piece that I wrote immediately after the Delhi gang-rape incident stated:
“I wish to clearly state that it would be fatal to confine the urge for changes to “safety of women alone” or, for that matter, demand for stricter provisions to prevent rape. This line of action is being deliberately highlighted under pressure from feminist wings, tactically supported by Congress government, which hopes to regain power with female voters and minority card in next Parliamentary actions. The mainstream media is also singing the same tune, because in wake of fear to lose government’s aid, it has no other option but to toe the stance taken by government. This whole drama which captured the nation’s attention from December 16, 2012, until death of gang-rape victim was a well-orchestrated show managed perfectly well by the paid media and Congress government. There are enough circumstantial evidences which give proof of it that the real story is something else and it’s more horrible than what we all came to witness in these past turbulent fifteen days. I will deal with this aspect later in this article but first let’s not ignore these pertinent points.”
The readers can have a look at that article to ascertain what could be the reasons, which indicate at involvement of hidden players in the orchestrated drama, which took place in the wake of gang rape. Now after the suicide of the main accused, which is apparently cold blooded murder, it would be quite obvious to thinking minds that real picture is indeed a “dirty picture”. And like always the real mastermind-the real villains-shall have the last laugh. I do not wish to shoot arrow in darkness since in absence of concrete facts there is always risk of arriving at flawed conclusions. However, there are enough circumstantial evidences to prove that police is merely a puppet in the hand of chief villain. The police was no more than a puppet when the gang rape occurred, and even now in the aftermath of the suicide of Ram Singh-the prime accused- is nothing but a puppet.
It has now become certain that we would not come to know what exactly happened in the name of gang-rape. All we know that a beautiful girl came to lose her life in a painful way. This case would remain an unresolved dilemma like the Ayushi murder case. It’s a painful scenario that conscious citizens can do nothing much other than being mute spectators. However, the citizens can remain alert by beginning to see beyond the obvious. That way they would begin to become aware of the great politics played in their name. That would be the beginning of making better changes in the system from the top to the bottom.

The Indian democracy is said to be governed by the will of people. It’s not the entire truth. In reality, it’s governed by chosen contradictions. They make us sad, frustrated and gloomy. This time I would not enter into any sort of complicated analysis. Just presenting two news items side-by-side. That would be suffice to make Indians realize that not all is well with this country. The first news item is related with Saheed Capt. Amit Bhardwaj’s birth anniversary. The second news item is related with murder of a Deputy Superintendent of police, Zia ul Haq in Deoria, in Uttar Pradesh.
By means of contrast I wish to know are our soldiers sacrificing their lives for such rulers who appear to be no better than murderers? And secondly, do our citizens, which include judges and bureaucrats too, have no other option other than to live under shadow of such criminals posing as rulers? Anyway, RIP Kargil Saheed Capt. Amit Bhardwaj/Zia ul Haq. We shall always remain indebted to your glorious sacrifice. And for such rulers, it’s better that they get punished instead of making an attempt to define their worth.
Now the mother of all questions: If that’s the fate of high ranked police officials, how can the judiciary expect a common man to act as whistle blower? Any answers?

Capt. Amit Bhardwaj was leading the reinforcement column of 35 men when they were ambushed en route by Pakistani soldiers armed with light & medium weaponry. With the help of Havildar Rajbir Singh, he decided to divert the attention of the enemy & ordered his Second-in-Command to get the men out of the battle area. The two gallant men were killed, the others survived, though all were wounded. Capt. Bharadwaj saved nearly 30 of his men and killed more than 10 infiltrators, though he himself was hit twice fighting till the last breath. His body lay in deep valley of Himalayas, till it was retrieved on July 13, 1999. The bodies of Captain Bhardwaj and Havildar Singh 57 days later.

“But this is not the first time that Raja Bhaiya is finding himself under scrutiny for death of a policeman. In 2007, DSP Ram Shiromani Pandey, the investigating officer in the POTA case against Raja Bhaiya, died in a road accident on the eve of his approaching the Allahabad high court seeking action against him. Questions were raised, but nothing could be proven and Raja Bhaiya remained as powerful as ever.”
If that’s the fate of high ranked police officials, how can the judiciary expect a common man to act as whistle blower? Any answers?
